บทคัดย่อ

สถานการณ์ความขัดแย้งอันเนื่องมาจากข้อพิพาทด้านเขตแดนทางทะเลระหว่างประเทศไทยและประเทศกัมพูชาที่ค่อย ๆ ปะทุขึ้นอย่างช้า ๆ ในรอบปีที่ผ่านมา ส่งผลกระทบโดยตรงต่อคุณค่าพื้นฐานของระบบความสัมพันธ์และกฎหมายระหว่างประเทศหลังสงครามโลกครั้งที่ 2 อันได้แก่ สันติภาพและความมั่นคงระหว่างประเทศ อย่างไรก็ดี ในปัจจุบัน กลับยังไม่มีงานศึกษาทางวิชาการใดที่ออกมานำเสนอข้อเท็จจริงเกี่ยวกับสถานการณ์ข้อพิพาทที่เกิดขึ้นอย่างแพร่หลาย ตลอดจนนำเสนอทางออกข้อปัญหาในการแก้ไขหรือบริหารจัดการข้อพิพาทดังกล่าวเหมาะสมและก็ให้เกิดความยุติธรรมอันจะนำไปสู่ความสัมพันธ์อันดีระหว่างคู่พิพาทต่อไปในอนาคต ดังนั้น บทความฉบับนี้จึงมีเป้าหมายหลักอยู่ที่การนำเสนอรูปแบบของ “การบริหารจัดการ” ข้อพิพาทด้านเขตแดนทางทะเลระหว่างไทยกับกัมพูชา โดยอาศัยการศึกษาเปรียบเทียบรูปแบบการบริหารจัดการข้อพิพาทด้านเขตแดนทางทะเลที่มีอยู่ทั่วโลกเพื่อค้นหารูปแบบที่มีความเหมาะสมกับบริบทของประเทศไทยมากที่สุดมาจัดทำเป็นข้อเสนอสำหรับการปรับใช้ในกรณีข้อพิพาทข้างต้น
