Control of Pesticides for Agricultural Production According to Thai Law Compared to International Law

Abstract

The purpose of this research was the preliminary studies on the control of pesticides legislations for agricultural production. It was compared with foreign legislations to propose a solution to amend the law. The results of the study showed that the Hazardous Substance Act 1992 has been a law that governs all types of chemicals. On the other hand, the Republic of India and the Federation of Malaya both have specific laws governing pesticides. Nowadays, the European Union has adopted the Regulation (EC) No 1907/2006 Concerning the Registration, Evaluation, Authorization, and Restriction of Chemicals, or REACH, as a single system to regulate chemicals produced and distributed in the European Union. Which is a generally accepted practice. In Thailand, the Hazardous Substance act should be amended to give the authority to enact subsidiary legislations with civil society participation in the subsidiary legislations of the control of pesticides for agricultural production.
