@article{หลวงเมือง_2015, place={Ubon Ratchatani,Thailand}, title={กรณีศึกษาเกี่ยวกับ การคุ้มครองสิทธิผู้เสียภาษีอากรที่ได้รับเงินค่าใช้ที่ดินเพื่อการติดตั้งเสาส่งไฟฟ้าแรงสูง จากการไฟฟ้าฝ่ายผลิตแห่งประเทศไทย}, volume={8}, url={https://so06.tci-thaijo.org/index.php/law_ubu/article/view/84733}, abstractNote={<p>การไฟฟ้าฝ่ายผลิตแห่งประเทศไทยซึ่งเป็นหน่วยงานของรัฐ (รัฐวิสาหกิจ) ได้อาศัยอำนาจตามพระราชบัญญัติการไฟฟ้าฝ่ายผลิตแห่งประเทศไทย พ.ศ.2511 ออกคำสั่งทางปกครองเข้าไปใช้ที่ดินของประชาชนเพื่อวางเสาไฟฟ้าแรงสูงตามแนวสายส่งที่กำหนดเพื่อจ่ายไฟให้การไฟฟ้าส่วนภูมิภาค และการไฟฟ้านครหลวง เพื่อไปจำหน่ายไฟฟ้าให้แก่ประชาชน อันเป็นการกระทำเพื่อประโยชน์แก่สาธารณชนทั่วไป ซึ่งไม่มีกำหนดระยะเวลาสิ้นสุด โดยรัฐได้จ่ายค่าใช้ที่ดินแก่เจ้าของที่ดินนั้น โดยกรมสรรพากรได้วินิจฉัยตีความว่า เงินได้ที่เจ้าของที่ดินได้รับต้องนำมาเสียภาษีเงินได้บุคคลธรรมดา การศึกษาเรื่องนี้จึงวัตถุประสงค์เพื่อศึกษาว่า ผู้ได้รับเงินดังกล่าวสมควรได้รับยกเว้นไม่ต้องนำมารวมคำนวณเพื่อเสียภาษีเงินได้บุคคลธรรมดา</p><p>ผลการศึกษาพบว่า การไฟฟ้าฝ่ายผลิตแห่งประเทศไทย อาศัยอำนาจตามกฎหมายเข้าไปใช้ที่ดินของประชาชนเพื่อตั้งเสาสายส่งไฟฟ้าแรงสูงเป็นการใช้อำนาจทางปกครองที่จัดทำบริการสาธารณะขั้นพื้นฐานแก่ประชาชน โดยออกคำสั่งทางปกครอง ดังนั้น เงินค่าทดแทนการใช้ที่ดินที่เจ้าของที่ดินได้รับจากการไฟฟ้าฝ่ายผลิตมีลักษณะเป็นการจ่ายเพื่อบรรเทาหรือเยียวยาความเสียหายที่ได้รับจากการใช้อำนาจของการไฟฟ้าฝ่ายผลิตแห่งประเทศไทย ในกรณีนี้จึงสมควรได้รับการยกเว้นภาษีเงินได้บุคคลธรรมดา และเพื่อมิให้เกิดปัญหาการตีความจึงควรปรับปรุงแก้ไขกฎหมายที่เกี่ยวข้องให้ชัดเจน</p><p> </p><p><strong>The Protection Of  Taxpayer Right : Case Study Of The Imposition Of Personal Income Tax For Use The Land Of The Electricity Generating Authority Of Thailand</strong><strong></strong></p><p class="NoSpacing">The Electricity Generating Authority of Thailand (EGAT) ,which is the state enterprise by virtue of the Electricity Generating Authority of Thailand Act BE 2511, issued an administrative order to use the land of the people to bone struct the high voltage transmission towers supplying lines for the electric current to the Provincial Electricity Authority and the Metropolitan Electricity. The ultimate goal is to sell electricity to the public, which is An act for the common benefit of the public interest. The EGAT. pay the compensation for use the land to the land owners. In the case, The Revenue Department of Thailand is stipulated that the compensation for use the land to the land owners should not be exempted from personal income tax. The objective to study is to find out whether the compensation for use the land to the land owners should be exempted personal income tax or not.</p><p>The study shows : The compensation received from the Electricity Generating Authority of Thailand (EGAT) in this case it should be exempted from the personal income tax.
