Due to the spread of Covid-19 pandemic, the Thai government therefore chose to impose a state of emergency nationwide on 26 March 2020 by virtue of the 2005 Emergency Decree on Public Administration in Emergency Situation. This article seeks to assess the necessity and proportionality regarding the application of this law in the light of constitutional emergency models proposed by Carl Schmitt, Giorgio Agamben, Bruce Ackerman, David Dyzenhaus, and Oren Gross.
