Abstract

This article aims to study and analyze the legal philosophy through the case study of a Korean series “The Killing Vote”. The main idea concentrated on the possibility events in certain situations if the votes of people in the country could lead, and can be used to decide the fate of criminals, which resulting in the conflicting opinions of the main characters. The issue is around concerning correctness and fairness, whether punishing criminals in this way is appropriate or not. We, therefore, brought up the issue in this matter, analysis those conflict through the legal philosophy concepts of the Utilitarianism of Jeremy Bentham, and Pure Theory of Law of Hans Kelsen.
