The Development of Policy and Law Concerning Elder’s Asset Management

Abstract

This study has purposes as follow: 1) to study facts, problems and policies related to elderly property management in Thailand, 2) to study and analyze the pattern of elderly property management according to foreign laws and 3) to propose a model of elderly property management that suitable for Thailand. It is a qualitative research and documentary research conducted by collecting and analyze data presented in a descriptive writing format.
The research result finds that:
1. In the past, government policies have focused on supporting income or welfare for the elderly in need. While managing the assets of the elderly is also important.
2. When studying the pattern of asset management in foreign countries, it was found that there are interesting patterns: setting up a guardian to manage the elderly’s property, establishing a trust, and a reverse mortgage loan.
3. The government should formulate a policy towards the management of the elderly's assets continuously in the long term that is appropriate and concrete, establish legal measures on the governing of elderly property under the Civil and Commercial Code, promoting the Private Asset Management Trust Act, and improve the reverse mortgage loan model to meet the needs of the elderly.
