Legal Measure Pertaining to Control Marijuana for Recreation Use

Abstract
These days, the decriminalization of marijuana is a concept that is now permissible in many nations' laws. It can be seen that many countries have amended or repealed existing laws and implemented new ones to legalize marijuana. For such reason, Thailand has also issued control measures to regulate marijuana for recreational use which are the notification of the Ministry of Public Health on Identifying the Name of Category 5 Narcotics B.E.2565 (2022) and the notification of the Ministry of Public Health on Controlled Herbs (Marijuana) B.E.2565 (2022) [Dated 11 November B.E.2565 (2022)]. The purpose of this researh is to study the controlling measures for marijuana for recreational use by comparing Thai and relevant foreign laws.
According to the research, it is found that both legislations remain unclear in terms of definition. Furthermore, the criteria used as a controlling measure to regulate marijuana for recreational use still do not cover law enforcement. The author views that enacting specific legislation, such as the Marijuana Act, to cover the interpretation and enforcement of the law would be a solution to the ambiguity in law enforcement under the existing laws.
