Protection of Indigenous Plant Species: Studying the Access and Sharing of Benefits from Using Indigenous Plant Species

Abstract

          The purpose of this thesis is to study the access and sharing of benefits from using local domestic plant varieties, comparing Thai law with laws of India and Indonesia, including the Principles of the Convention on Biological Diversity. The study adopted qualitative method by collecting data from several documents including legal texts of Thailand and abroad, textbooks, article, thesis, papers, research papers, and various electronic data. Both of Thai and foreign languages.
          The study, the researcher found of problems showed Thai Plant Varities Protection Act 1999 lacks of regulation of utilization and benefit sharing in local domestic plant Varieties.This paper recommended that Thailand should revise the Act by adding regulation of utilization and benefit sharing in local domestic plant Varieties into section 48 and section 49
