บทคัดย่อ
การศึกษานี้วิเคราะห์โครงสร้างเชิงสถาบันในการจัดการประเด็นลิขสิทธิ์สำหรับห้องสมุด ผ่านการ ศึกษาเปรียบเทียบระหว่างประเทศไทยกับประเทศญี่ปุ่น โดยใช้ระเบียบวิธีวิจัยเชิงคุณภาพ อิงจากการวิเคราะห์กฎหมายลิขสิทธิ์ เอกสารทางราชการ ระเบียบ ข้อกำหนดของหน่วยงานที่เกี่ยวข้อง และวรรณกรรมทางวิชาการที่เกี่ยวข้อง ผลการศึกษาชี้ให้เห็นว่า ประเทศญี่ปุ่นมีการพัฒนากลไกเชิงสถาบันที่มีลักษณะเป็นระบบ โดยมีองค์กรกลางทำหน้าที่เป็นกลไกประสานระหว่างห้องสมุดและเจ้าของลิขสิทธิ์อย่างเป็นรูปธรรม ในขณะที่ประเทศไทยยังขาดกลไกการจัดการในลักษณะดังกล่าว ส่งผลให้ห้องสมุดต้องเผชิญข้อจำกัดในการปฏิบัติตามกฎหมายลิขสิทธิ์ โดยเฉพาะในบริบทของยุคดิจิทัลที่เอื้อต่อการทำซ้ำและเผยแพร่ข้อมูลอย่างกว้างขวาง การศึกษานี้จึงนำเสนอข้อเสนอแนะเชิงนโยบายเพื่อการพัฒนาโครงสร้างเชิงสถาบันที่เหมาะสมกับบริบทของประเทศไทย อันจะสามารถรองรับความท้าทายทางกฎหมายและเทคโนโลยีที่กำลังเปลี่ยนแปลง
