มาตรการทางกฎหมายในการดำเนินการกับข้อมูลอันเป็นเท็จและข้อมูลบิดเบือนบนอินเทอร์เน็ต

บทความ เรื่อง มาตรการทางกฎหมายในการดำเนินการกับข้อมูลอันเป็นเท็จและข้อมูลบิดเบือนบนอินเทอร์เน็ตฉบับนี้ มีวัตถุประสงค์เพื่อศึกษามาตรการทางกฎหมายที่มีอยู่ในปัจจุบันและความจำเป็นในการปรับปรุงหรือพัฒนามาตรการใหม่ เพื่อจัดการกับปัญหาข้อมูลเท็จและข้อมูลบิดเบือนที่แพร่กระจายบนอินเทอร์เน็ต เนื่องจากข้อมูลอันเป็นเท็จและข้อมูลบิดเบือนที่มีจำนวนมากและหลากหลายที่ไหลเวียนในระบบอินเทอร์เน็ตอาจมาจากแหล่งต่าง ๆ ที่สร้างขึ้นโดยมนุษย์โดยตรงหรือผ่านระบบอัตโนมัติที่ถูกออกแบบมาให้ดูน่าเชื่อถือและยากที่จะแยกแยะจากข้อมูลจริง การศึกษานี้ชี้ให้เห็นว่า มาตรการทางกฎหมายที่มีอยู่เดิมอย่างพระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2550 และมีการแก้ไขเพิ่มเติมเป็นพระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2560 แล้ว แต่ในมาตรา 3 ยังไม่มีการนิยามคำว่า “ข้อมูลเท็จ” และ “ข้อมูลบิดเบือน” และตามมาตรา 14 เป็นข้อบัญญัติสำคัญที่กำหนดความผิดเกี่ยวกับการนำข้อมูลคอมพิวเตอร์เข้าสู่ระบบคอมพิวเตอร์โดยมิชอบกฎหมายไม่ได้กำหนดชัดเจน ทำให้การตีความขึ้นอยู่กับดุลยพินิจของเจ้าหน้าที่ ซึ่งอาจทำให้เกิดการบังคับใช้ที่ไม่เป็นธรรม ที่ไม่ครอบคลุมและสอดรับกับปัญหาที่เกิดขึ้นในปัจจุบัน การศึกษานี้มุ่งวิเคราะห์เปรียบเทียบกฎหมายต่าง ๆ ที่เกี่ยวข้องกับปัญหาข้อมูลเท็จและข้อมูลบิดเบือน ทั้งของไทยและต่างประเทศ เพื่อกำหนดกรอบแนวทางในการปรับปรุงและพัฒนากฎหมายให้เหมาะสมและสอดคล้องกับสภาพการณ์ของสังคมไทยในปัจจุบันและบริบทของประเทศ ดังนั้น จึงจำเป็นต้องมีมาตรการทางกฎหมายที่เหมาะสมและมีประสิทธิภาพในการควบคุมและจัดการกับข้อมูลเท็จและข้อมูลบิดเบือนบนอินเทอร์เน็ต เพื่อรักษาความน่าเชื่อถือและความปลอดภัยของข้อมูล รวมทั้งคุ้มครองสิทธิและผลประโยชน์ของผู้ใช้อินเทอร์เน็ต
