Feminist Jurisprudence: On Luce Irigaray’s Sexuate Rights

This article derives from a doctoral dissertation in interdisciplinary studies entitled “Life and Experience of Mothers/Wives in Family Mediation Process in the Roi Et Juvenile and Family Court”. This dissertation studies the missing voice of women in the mediation room court. The key point of this dissertation is to give solutions to improve mediation practices from Luce Irigaray’s philosophy of sexual difference. Applying Irigaray’s concept enriches the existing Thai scholarship on feminist jurisprudence, since the previous literature in this field emphasized sexual equality. Therefore, this essay aims to demonstrate the sexual difference concept. This paper consists of four components: (1) review feminist legal studies, (2) introduce Irigaray’s philosophy on sexual difference, (3) illustrate her idea on sexuate rights, and (4) propose the possibility of Irigaray’s sexual difference in framing Thai laws and Family mediation.
