The Legal Problems of Online Veterinary Drug Selling

This article aimed to explore concepts, theories and laws related to online veterinary drug selling in Thailand and elsewhere. The situations and regulatory measures of online veterinary drug selling in foreign countries, namely the United States of America and the United Kingdom, were studied. Additionally, animal and owner identifications in those two countries were reviewed. These provide guidance on how to revise, modify, and add some legislation for online veterinary drug selling in Thailand to make it safer and in line with current technological development as well as the situation and social contexts of the country.
The result of the study found that Thai online veterinary drug selling has faced four problems. First, determining the types of veterinary drugs that are prohibited for online selling is problematic. Second, it is the limitation on the designation of the premise where veterinary drugs are sold. It must be the place specified in the license. The problem is on an interpretation of whether it covers the online sale of veterinary drugs. Third, it is the identification of an operating person, including a veterinarian or pharmacist, that provides online consultations to customers via electronic means. This should be like being on-site. Lastly, it is a problem to identify animals and owners that may result in fraudulent buying of veterinary drugs for illegal use.
Based on the result of the study, the researcher was recommended that issuing specific legal measures regarding online veterinary drug selling. In which, the veterinary drug must be sold online under the conditions that the licensee must have a definite physical location as the place of sale. A veterinarian or pharmacist is on duty at the sales site during all hours of operation, and electronic identity verification is performed when selling veterinary drugs. There must be a system in which buyers can be assessed and consulted with the operating person like face to face. In addition, pets should be implanted with a microchip and registered to identify the animal and its owner so that fraudulent purchases for illegal use are prevented. These measures help improve the standard of online veterinary drug selling in Thailand.
