การออกเสียงประชามติ : กระบวนการประชาธิปไตยทางตรงสมัยใหม่

Abstract
การออกเสียงประชามติ (Referendum) นับเป็นรูปแบบหนึ่งของกระบวนการปกครองตามหลักประชาธิปไตยทางตรง (Direct democracy) เมื่อกล่าวถึงรากฐานความเป็นมาทางประวัติศาสตร์ของการออกเสียงประชามติ นักวิชาการจึงมักจะเชื่อมโยงการออกเสียงประชามติสมัยใหม่ เข้ากับหลักการการปกครองที่ตั้งอยู่บนการมีส่วนร่วมตัดสินใจอิสระโดยตรงพลเมือง ในการปกครองแบบประชาธิปไตยเอเธนส์และรวมถึงการมีส่วนร่วมออกเสียงในสภาของประชาชนในสาธารณรัฐโรมัน
อย่างไรก็ตาม แม้การออกเสียงประชามติสมัยใหม่ จะตั้งอยู่บนหลักการปกครองแบบประชาธิปไตยทางตรง แต่ก็ต้องตระหนักว่ารูปแบบการมีส่วนร่วมตัดสินใจทางการเมืองแบบประชาธิปไตยทางตรงสมัยใหม่ (Modern direct democracy) นั้น มีความแตกต่างจากรูปแบบการปกครองแบบประชาธิปไตยทางตรงยุคกรีกและโรมันโบราณ รวมถึงการปกครองตนเองของพลเมืองในนครขนาดเล็กแถบยุโรปในยุคกลาง
ในขณะที่การมีส่วนร่วมตัดสินใจทางการเมืองการปกครองของพลเมืองในแบบประชาธิปไตยทางตรงยุคโบราณนั้น มีฐานะเป็นกระบวนปกครองของนครรัฐ นั่นคือ การใช้อานาจการปกครองตนเองร่วมกันของพลเมือง โดยการร่วมเสนอประเด็น อภิปรายโต้แย้ง และออกเสียงตัดสินใจทางการเมืองของนครรภายในสภาประชาชน แต่กรณีของการออกเสียงประชามติ ซึ่งถือเป็นรูปแบบของการใช้อานาจตัดสินใจทางการเมืองของพลเมืองแบบประชาธิปไตยทางตรงสมัยใหม่นั้น เป็นกลไกหรือสถาบันทางการเมืองที่ดารงอยู่ในฐานะส่วนหนึ่งของระบบการเมืองการปกครองแบบตัวแทน
ดังนั้น การออกเสียงประชามติในฐานะที่เป็นกลไกการมีส่วนร่วมทางการเมืองตามหลัก “ประชาธิปไตยทางตรง” จึงหมายความถึงรูปแบบการมีส่วนร่วมตัดสินใจทางการเมืองโดยตรงของประชาชนภายใต้ระบอบประชาธิปไตยแบบตัวแทน (Representative democracy) ซึ่งมีนัยต่างจากการตัดสินใจทางการเมืองโดยตรงของประชาชนที่เป็นการปกครองแบบประชาธิปไตยบริสุทธิ์ (Classical andpure democracy) ดังเช่น ประชาธิปไตยทางตรงในกรีกโบราณ (Athenian direct democracy) หรือการออกเสียงตัดสินใจของพลเมืองในสภาประชาชนกล้างแจ้งของชาวสวิส (Landsgemeinden) หรือที่ประชุมสภาเมืองของชาวอเมริกันในแถบนิวอิงแลนด์ (Town meeting) เป็นต้น
