อนุสัญญาฉบับที่ 87 และ 98 ขององค์การแรงงานระหว่างประเทศ: การทบทวนบริบททางประวัติศาสตร์เพื่อการตัดสินใจ ให้สัตยาบันของรัฐบาลไทย

บทคัดย่อ

บทความนี้อธิบายบริบทประวัติศาสตร์ของอนุสัญญาฉบับที่ 87 และ 98 ขององค์การแรงงานระหว่างประเทศ และการให้สัตยาบันอนุสัญญาโดยหลักการมุ่งส่งเสริมและคุ้มครองสิทธิขั้นพื้นฐานของแรงงาน แต่จากการวิเคราะห์บริบททางประวัติศาสตร์ พบว่าสหรัฐอเมริกาตั้งใจใช้อนุสัญญาสองฉบับนี้ต่อต้านสหภาพโซเวียตและครอบงำประเทศโลกที่สาม หลังสงครามเย็นอนุสัญญาสองฉบับนี้ ได้รับการบรรจุเป็นส่วนหนึ่งของมาตรฐานแรงงานหลักในฐานะเป็นเครื่องมือ สนับสนุนความได้เปรียบทางการค้าระหว่างประเทศให้แก่ประเทศที่พัฒนาแล้ว การศึกษาบริบททางประวัติศาสตร์ทั้งในมิติความสัมพันธ์ระหว่างประเทศ บทบาทของสหรัฐอเมริกาต่อการให้สัตยาบัน และผลกระทบของการให้สัตยาบัน จึงมีความสำคัญอย่างยิ่ง และอาจจะสำคัญยิ่งกว่าเนื้อหาของอนุสัญญา
