ผู้ตรวจการเลือกตั้ง: บทเรียนจากการทำหน้าที่ตรวจสอบการเลือกตั้ง

บทคัดย่อ
ผู้ตรวจการเลือกตั้งเป็นนวัตกรรมใหม่ของการเลือกตั้งที่เกิดจากแนวคิดของคณะกรรมการร่างรัฐธรรมนูญซึ่งถูกนำมาใช้แทนที่คณะกรรมการการเลือกตั้งประจำจังหวัด เพื่อตรวจสอบการปฏิบัติงานของเจ้าหน้าที่และตรวจสอบการกระทำผิดกฎหมายเลือกตั้ง บทความนี้มีวัตถุประสงค์เพื่อถอดบทเรียนการทำงานของผู้ตรวจการเลือกตั้งประจำจังหวัดในการเลือกตั้งทั่วไป เมื่อวันที่ 24 มีนาคม 2562 และสรุปบทเรียนจากการทำหน้าที่ตรวจสอบการเลือกตั้ง แล้วนำเสนอแนวทางปรับปรุงแก้ไขที่เหมาะสม โดยใช้วิธีการศึกษาค้นคว้าทางด้านเอกสารและจัดเก็บข้อมูลจากการสัมภาษณ์เชิงลึกจากผู้ตรวจการเลือกตั้งประจำจังหวัดในแต่ละภาคและประสบการณ์ของผู้เขียน
ผลการศึกษาพบว่า ผู้ตรวจการเลือกตั้งประจำจังหวัดมีอิสระในการทำงานแต่ขาดการประสานการทำงานร่วมกัน ขาดความเชี่ยวชาญและแม่นยำในกฎหมายเลือกตั้งความไม่ชัดเจนในอำนาจหน้าที่ทำให้เกิดความคลุมเครือในบทบาท ผลงานการตรวจสอบการทุจริตการเลือกตั้งยังไม่สามารถเห็นเป็นรูปธรรม มีความขัดแย้งกับสำนักงานคณะกรรมการการเลือกตั้งประจำจังหวัด อีกทั้งการมีผู้ตรวจการเลือกตั้งประจำจังหวัดมาจากจังหวัดอื่นอาจทำให้มีปัญหาในการไม่รู้จักคน ไม่รู้จักพื้นที่
บทสรุปของบทความนี้ ยังคงเห็นความสำคัญของผู้ตรวจการเลือกตั้ง เพราะรายงานการตรวจสอบการเลือกตั้งจะช่วยทำให้คณะกรรมการการเลือกตั้งมีความมั่นใจอย่างสมเหตุสมผลในการพิจารณาประกาศผลการเลือกตั้ง และเป็นหลักประกันในความโปร่งใสในการปฏิบัติงานที่สามารถตรวจ
บทความนี้ได้เสนอแนวทางการปรับปรุงแก้ไขที่เหมาะสม ผู้ตรวจการเลือกตั้งประจำจังหวัดต้องเรียนรู้การทำงานร่วมกัน ต้องมีความรู้ ความเชี่ยวชาญ แม่นยำในระเบียบกฎหมาย ต้องมีความชัดเจนในบทบาทและความมีสาระสำคัญในประเด็นที่ตรวจสอบ ต้องเป็นคนที่มีความช่างสังเกตและสงสัย สามารถสังเกตเห็นสิ่งผิดปกติที่เกิดขึ้นได้อย่างรวดเร็ว มีความสามารถในการแก้ไขปัญหาความขัดแย้งในเชิงสร้างสรรค์ต้องมีสมรรถนะในการปรับตัวให้เข้าถึงคน เข้าถึงพื้นที่ ได้อย่างรวดเร็ว และการประเมินผลการปฏิบัติงานต้องเป็นธรรม
