อดีต อุบาทว์ อนาคต: ธรรมาภิบาลและการร่วมใช้อำนาจหลายภาคส่วน กับการป้องกันการทุจริตในองค์กรปกครองส่วนท้องถิ่น

บทคัดย่อ

บทความวิชาการฉบับนี้มุ่งพิเคราะห์บทบาทของหลักธรรมาภิบาลในการป้องกันการทุจริตในองค์กรปกครองส่วนท้องถิ่นไทยโดยเสนอว่า การทุจริตมิได้เป็นเพียงพฤติกรรมเฉพาะบุคคลของผู้ใช้อำนาจ แต่เป็นผลผลิตของโครงสร้างอำนาจที่บิดเบี้ยว ซึ่งถูกหล่อหลอมผ่านกระบวนการรวมศูนย์ การแทรกแซงทางการเมือง และวัฒนธรรมระบบอุปถัมภ์ที่ฝังรากลึกมาอย่างต่อเนื่อง การมอบอำนาจจากส่วนกลางสู่องค์กรปกครองส่วนท้องถิ่นภายใต้แนวนโยบายการกระจายอำนาจที่เสมือนเป็นการเสริมสร้างความเป็นอิสระในการบริหารพื้นที่ แต่ในทางปฏิบัติกลับขาดการออกแบบกลไกกำกับตรวจสอบที่รัดกุมและสมดุล จนก่อให้เกิดช่องว่างเชิงอำนาจ ที่เอื้อให้การใช้อำนาจในระดับท้องถิ่นกลายเป็นเครื่องมือในการแสวงหาผลประโยชน์โดยมิชอบ มากกว่าจะเป็นกลไกในการขับเคลื่อนประโยชน์สาธารณะ ส่งผลให้องค์กรปกครองส่วนท้องถิ่นบางแห่งที่อยู่ภายใต้เงื่อนไขความเสี่ยง
เชิงโครงสร้าง อาจตกอยู่ในวงจรอุบาทว์ของการใช้อำนาจในลักษณะที่ปราศจากหลักธรรมาภิบาล บทความนี้จึงเสนอแนวทางใหม่ในการออกแบบกลไกการบริหารท้องถิ่นที่ยึดโยงกับหลักธรรมาภิบาล ผ่านกรอบแนวคิดการร่วมใช้อำนาจหลายภาคส่วน ซึ่งมุ่งเน้นการปรับโครงสร้างความสัมพันธ์ระหว่างรัฐกับประชาชน โดยเปิดโอกาสให้ภาคประชาชน ภาคเอกชน และภาคประชาสังคม เข้ามามีบทบาทร่วมกำหนดนโยบาย ตัดสินใจ และตรวจสอบอย่างเท่าเทียม การเปลี่ยนผ่านจากรัฐผู้ควบคุมไปสู่รัฐผู้ประสานผลประโยชน์สาธารณะ คือหัวใจสำคัญของการวางรากฐานรัฐประชาธิปไตยท้องถิ่นที่มีประสิทธิภาพ โปร่งใส และยึดโยงกับประชาชนอย่างแท้จริง
