THE PREVENTION OF CONTAGIOUS DISEASES FOR INMATES IN THE PRISONS AND INSTITUTIONS

Abstract

This research article is a legal research study with the objectives of studying about 1) the prevention of contagious diseases for inmates in the prisons and institutions according to Thai punishment law and foreign law. 2) Adopting legal measures from foreign law that is different and appropriate for Thai society to amend Thai penal law and it is a qualitative research by studying document including laws, regulations, orders, theses, dissertations, and related websites, both Thai and foreign. Quantitative research method is in - depth interview from Prison Commanders, Directors of Institutions, nurses, and prison officers who have completed nursing training on the number of: 24 persons. Questions are checked by specialists and used to analyze data. The research results found that the prevention of infectious diseases for inmates are not appropriate due to the lack of specialized doctors in the prisons and institutions, and inmates’ health are not checked on the first day of the entry into the prisons and institutions immediately everyday as provided by laws. Solving the problems is to provide scholarships to medical students on funds of inmate vocational training and after the medical students graduate to perform duties at the medical facilities of the prisons and institutions that are the owner of the scholarship. The shortage of medicines, medical materials, and medical device, Department of Corrections must allocate sufficient budget similar to the principles of the foreign laws. Overcrowding of inmates, there must be a provision of laws designated sleeping areas for inmates according to international standards legislation to delay prosecution, holiday detention, home detention of the offenders and setting up private prisons. they will reduce overcrowding of inmates and to prevent contagious diseases from the outside into the prisons and institutions, and to prevent them from there to outside
