ADOPTING THE CONVENTION CONCERNING INTERNATIONAL CARRIAGE BY RAIL (COTIF) IN ASEAN: IMPLEMENTATION STRATEGIES AND LEGAL HARMONIZATION FOR THAILAND

Abstract

The Convention Concerning International Carriage by Rail (COTIF) is a pivotal framework for regulating international rail transport, widely adopted in Europe and other regions. Although rail transportation has been used for ages in Thailand, for both transporting people and goods, but Thailand has never been a member of COTIF. Currently Thailand still has a significant problem that the law related to railway liability has not been improved for a long time. When Thailand try to develop the rail transportation for supporting an expansion of economic and society, by attempting to connect the way for traveling and goods shipment between countries, it is necessary to have effective laws both for prevention or solvation disputes that may arise in rail transport operations. This research purposes consist of: 1. To assess the feasibility of implementing COTIF in ASEAN, especially focusing on Thailand; 2. To identify potential challenges in harmonizing legislation and infrastructure development; 3. To propose an implementation strategy to facilitate the implementation of COTIF and increase regional rail connectivity. This study applied qualitative research methods which focused on document analysis and comparative analysis. Finally, the results of the research founded that Thailand should accept and become a member of the Convention Concerning International Carriage by Rail (COTIF) and should amend domestic laws to comply with this convention in order to raise Thailand's rail transportation to comply with the international standard as other countries.
