The Study Problems and Solutions of the Inheritance under Islamic Law : A Case Study of Muslim Religious Leaders in Narathiwat Municipality

Abstract

This research is a qualitative study and has an objective to study Islamic law of provisions governing the inheritance and to study problems and to solve the problem of inheritance under Islamic law in urban area of Narathiwat  by studying the documents, Qur'an, al-Hadith, research and internet. It survey data and interviews to collect data using specific samples of 10 Muslim religious leaders and presents data in the form of descriptive analysis. The study indicated that Islamic provisions governing the inheritance, Islamic law give a Muslim to heritage management. The estate of the deceased owner's heirs have a right to inherit. On the problem of inheritance, there are many issues that are important, namely the problem was not satisfied with the share received, problems to deal and delays in inheritance which causes problems for many reasons as follows,  problem of management and heir to inherit each other does not comply with the provisions of Islamic law. These issues are caused by several factors namely   while legal or intestate estate given to the heir or other non-successor while he is still alive, It does not have to take written notes, no witness, no knowledge about inheritance under Islamic law and no trust between the heirs together.  It causes problems that affect the inheritance. There are many approaches and as follows, religious leaders are calling for the right to inherit a talk to an understanding together, giving a new divider a second time, training awareness about the inheritance provisions to Islamic community. If religious leaders cannot resolve the problem, it will refer the matter to the officers of the Provincial Islamic office. The best ways to solve the most successful is the way the religious leaders called for the right to inherit a talk to an understanding together. And this research agreed that while talking to an understanding should be qualified or adults who faithfully come together to make it easier to talk.
