Using the Constitutional Amendment Process to Replace a Constitution: A Remark on the Establishment of the Constitution of the Kingdom of Thailand AD 1946 under the Elite-Constructed Constitution Approach’s Perspective

The Constitution of the Kingdom of Thailand, enacted in 1946, is distinguished from all other constitutions enacted since 1932 by a particular trait. The constitution was created through a process of amendments. However, the resultant constitution was not one that had been amended. The constitution was written to replace the Constitution of the Kingdom of Thailand AD 1932. In other words, it was constructed using the amendment process to camouflage the replacement. Because they had complete control over a constitution-making body, incumbent political elites decided to use this process to redistribute their political power. These are the results of a study of the Constitution of the Kingdom of Thailand in AD 1946 using approaches to differentiate between constitutional amendment and constitutional replacement, as well as the elite-constructed constitution approach, which is illustrated in this article.
