From the elite-constructed constitution approach’s perspective, the Constitution of the Kingdom of Thailand B.E. 2475 can be considered one of the constitutions created by political elites to constrain their political conflicts and allocate political power under the new constitutional regime. This claim can be supported by investigating the constitutional development that emerged from conflicts among political elites, as well as the constitution-making process dominated by political elites with no public participation and constitutional provisions explicitly reflecting political elites’ negotiations on constitution-making. Another significant piece of evidence is the constitutional endurance that relied on political elites’ decisions. This article encourages readers to view the origin of the first constitution from this perspective, suggesting that Thai constitutional history began with political elites’ domination. Understanding constitutional development from the elite-constructed constitution approach is an important starting point for studying Thai constitutional history from a different perspective than the dominant conception of constitution-making. It can help us comprehend the history of multiple constitutional promulgations and cyclic coups that Thailand has experienced.
