IMPLEMENTATION OF THE NATIONALITY RETURN POLICY FOR THAI DIASPORA IN PRACHUAP KHIRI KHAN PROVINCE AND RANONG PROVINCE

Abstract
The objectives of this research were 1) to study the context of the emergence of the Thai diaspora and the problem conditions of the Thai diaspora in Prachuap Khiri Khan Province and Ranong Province, 2) to analyze the factors affecting the implementation of the policy on the reinstatement of Thai diaspora, 3) to study the impact of policy implementation on human rights principles on the reinstatement of the Thai diaspora, and 4) to suggest the guidelines for driving the implementation of government policies on the reinstatement of the nationality of Thai diaspora.
The results of the research showed that (1) the context and condition of the problem of displaced Thais in Prachuap Khiri Khan Province and Ranong Province changed over a period of time after Burma gained independence until the preparation of the Nationality Act (No. 5) B.E. 2555; (2) Factors affecting the implementation of the policy on the reinstatement of the nationality of displaced Thais are: 1) the state has clear policies and laws to enforce; 2) personnel resources for naturalization work are scarce, the authorities also lack an understanding of the law, and Regulations and budgets are limited; 3) communication in the practice unit with citizenship applicants is not thorough; 4) regional agencies are mainly waiting for central policy decisions; 5) there were unstable revenue structure, political policies change frequently, and social welfare is not accessible; and 6) officials focus on legal action rather than human rights. (3) Human rights impacts that Thai diaspora do not enjoy basic rights, such as medical care. education, occupation, travel, etc.
