Enforcement of the Motor Vehicles Act B.E. 2522: A Case Study of Payment for Motorcycle Taxis Vest in Nakhon Sawan Province

Abstract

The purposes of this research article were 1) to study the problems in enforcing the Motor Vehicle Act B.E. 2522 in the case of payment for motorcycle taxi vest; 2) to find the causes of the problems in enforcing the law; 3) to find ways to solve the problems in enforcing the Act; and 4) to find appropriate guidelines for enforcing the law. It was the qualitative research. The key information provider group was motorcycle taxi service providers, transportation office staff and related subdistrict administrative organizations obtained by purposive sampling using individual in-depth interviews. Data were analyzed by content analysis and presented descriptively. The results of the research found that 1) problems in law enforcement arose from insufficient inspection by government officials, undisclosed motorcycle taxis, Grab motorcycles, tribute or influential person, the owner of motorcycle taxi vest cannot get the money back for the motorcycle taxi vest, rider's consent; 2) the causes of the problem were from being notified or known before inspecting or inspecting only in the case of complaints. The riders and the service recipients knew each other personally. There was competition for passengers or overlapping areas. The law in force could not solve the problem of influencers. The value of the vest price was more expensive. Although there was fear, it was for their own survival; 3) in terms of how to solve law enforcement problems, active measures have been taken to crack down on influencers. Motorcycle stands were organized by government agencies. Penalties have been increased for those involved in the illegal vest business. All types of motorcycle taxis were controlled; and 4) in the aspect of appropriate practices, government officials should strictly enforce the law. There were measures in place to prevent intimidation or creating conditions by influential people. There were measures to protect the rights and freedoms of service recipients in choosing services.
