LEGAL PROBLEMS AND OBSTACLES CONCERNING ON THE PROTECTION OF INTERNATIONAL STUDENTS’ RIGHTS RESIDING IN THE KINGDOM OF THAILAND

Abstract

          This thesis aimed to study the historical background and significance of the issue regarding the protection of the rights of international students residing in Thailand. The study commences with a study of historical development, conceptual frameworks, and theories related to human rights protection. It also encompasses legal measures addressing the protection of human rights in both other countries and Thailand. This is done to facilitate an analysis of the problems and obstacles concerning on the protection of the international students’ rights in Thailand.From the study, it is evident that Thailand still has limitations in terms of protection the rights of international students residing, especially when compared to other countries. This is particularly related to education visas, where there is no provision allowing students with an education visa or those who have completed their studies in Thailand to apply for a visa extension to work after their graduation. The absence of regulations for establishing funds to ensure well-being, particularly in terms of healthcare rights, further exacerbates the issue. This pertains to rights concerning medical treatment, limitations on occupational activities while studying, and the right to form associations for international student communities. These constraints result in international students in Thailand not receiving adequate protection under human rights principles. Additionally, these limitations have implications on economic development, as they undermine the trust of international students in choosing Thailand as their educational destination.
