THE LAW REVIEWS OF CLIMATE CHANGE BILL B.E. ….

Abstract

The objectives of the current academic article were to: 1) study, analyze, and propose opinions on the (proposed) Climate Change Bill B.E. .... , 2) examine the foreign law related to Climate Change then compare with Thailand law, and 3) suggest more appropriate guideline for amendment of the (proposed) Bill. According to the study, it was found that to enact a law spend quite long time, and a non-implementation of international law obligations was not included in the law content. In addition, it has also been confused with the matters of the principle and rationale in (proposed) Bill. They were not clarified whether they were included in any implementation. Eventually, it seemed that this Bill was stated only in terms of a policy for collecting a greenhouse gas data. However, the practical content for achieving the obligations of the Paris Agreement issued pursuant to the provisions in Article 24 of the United Nations Convention on Climate Change A.D. 1992 was not found. Therefore, the author has proposed the amendment of the Bill mentioned prior to its effective in Thailand.
