การศึกษาเชิงวิเคราะห์กฎหมายโบราณจังหวัดพิษณุโลก

บทคัดย่อ
บทความวิจัยฉบับนี้มีวัตถุประสงค์เพื่อศึกษาลักษณะทางกายภาพและสารัตถะของต้นฉบับตัวเขียนกฎหมายโบราณจังหวัดพิษณุโลก เป็นการวิจัยเชิงคุณภาพโดยใช้ระเบียบวิธีวิจัยทางเอกสารศึกษาต้นฉบับกฎหมายโบราณ เอกสารจากสำนักศิลปะและวัฒนธรรม มหาวิทยาลัยราชภัฏพิบูลสงคราม จำนวน 46 ฉบับ 2,887 หน้าสมุดไทย ซึ่งผู้วิจัยได้ปริวรรตเป็นภาษาไทยปัจจุบัน ผลการศึกษาพบว่า เอกสารทุกฉบับบันทึกลงในสมุดไทยขาว หมึกดำ พบเอกสาร 5 ประเภท พบประเภทสมบูรณ์มากที่สุดจำนวน 18 ฉบับ เอกสารบันทึก 4-11 บรรทัดต่อหน้าสมุดไทย เอกสารบันทึกด้วยคำประพันธ์ 3 ประเภท คือ 1. บันทึกด้วยคำประพันธ์ประเภทร้อยแก้วมากที่สุด จำนวน 30 ฉบับ 2. บันทึกด้วยคำประพันธ์ประเภทร้อยแก้วและร้อยกรอง จำนวน 14 ฉบับ และ 3. บันทึกด้วยคำประพันธ์ประเภทร้อยกรอง จำนวน 2 ฉบับ บันทึกด้วยอักษรและภาษา 3 ประเภท คือ 1. บันทึกด้วยอักษรไทย ภาษาไทยมากที่สุด จำนวน 26 ฉบับ 2. บันทึกด้วยอักษรไทย ภาษาไทย และอักษรขอม ภาษาบาลี จำนวน 19 ฉบับ และ 3. บันทึกด้วยอักษรไทย ภาษาไทย และอักษรไทย ภาษาบาลี จำนวน 1 ฉบับ กฎหมายโบราณจังหวัดพิษณุโลกฉบับที่เก่าที่สุด คือ กฎหมายโบราณวัดกรับพวงเหนือ (3)/0373 บันทึกใน พ.ศ. 2305 ปลายสมัยกรุงศรีอยุธยา มีสารัตถะจำนวน 28 เรื่อง ส่วนใหญ่คล้ายคลึงกับกฎหมายตราสามดวงในสมัยต้นรัตนโกสินทร์ เช่น พระอัยการเบ็ดเสร็จ ประกาศพระราชปรารภ พระอัยการทาส หลักไชย พระอัยการลักษณะผัวเมีย พระอัยการลักษณะพยาน พระอัยการลักษณะรับฟ้อง พระอัยการลักษณะมรดก เป็นต้น จนสามารถสันนิษฐานได้ว่า กฎหมายโบราณจังหวัดพิษณุโลกได้รับอิทธิพลสำคัญจากกฎหมายตราสามดวง การศึกษาวิจัยครั้งนี้จะเป็นการขยายพรมแดนของการศึกษาเอกสารโบราณภูมิภาคภาคเหนือตอนล่างให้กว้างขวางต่อไป
