MEASURES TO ENFORCE LABOR LAWS OF ENTREPRENEURS ON FOREIGN WORKERS' WELFARE ARRANGEMENTS

Abstract

This research aims to 1) Study the background of entrepreneurs’ control over the welfare of foreign workers 2) Study the enforcement of labor law by entrepreneurs over the welfare of foreign workers and 3) Analyze the enforcement of labor law by entrepreneurs over the welfare of foreign workers. This research is qualitative and collects data from 15 participants who are specifically selected, consisting of representatives from the Ministry of Justice representatives from the Department of Social Development and Human Security, legal and human rights representatives, entrepreneurs, and foreign workers. The structured interviews are conducted and the data is analyzed in terms of content and presented in a narrative format. The research results are as follows: 1) Background of entrepreneurs’ control over the welfare of foreign workers The immigration of foreign workers due to the unfavorable economic situation results in insufficient income, followed by poverty. 2) Enforcement of labor law by entrepreneurs over the welfare of foreign workers Enforcement of labor law by entrepreneurs is entitled to receive a minimum wage not less than the specified amount. They are entitled to receive overtime pay in case of working overtime. Some types of foreign workers are entitled to apply for social security insurers.
and 3) Analysis of entrepreneurs’ enforcement of labor law by entrepreneurs over the welfare of foreign workers, consisting of 1) International law by the International Labor Organization Convention Regarding freedom of association protecting the right to organize for the benefit of work, International Labour Organization Conventions, and 2) Thai law, through the Foreign Workers Employment Act.
