Guidelines for Developing the Honor Court Procedure of Cadets of Chulachomklao Royal Military Academy

Abstract

          This research article aimed to study is a descriptive study. The objective was to investigate guidelines for developing the Honor Court Procedure for cadets of Chulachomklao Royal Military Academy. The key informants consisted of 33 members of the Honor Court Committee, along with 10 faculty members and commanding officers. Research instruments included two sets of focus group discussion forms: 1) for the Honor Court Committee and 2) for faculty members and commanding officers. The research results were found as follows; the guidelines for developing the Honor Court procedure consist of three distinct stages:1. Pre-Inquiry Stage When a cadet witnesses a violation of the honor system, they must report the incident to a cadet leader or a commanding officer. Fact-Checking: The cadet leader or commanding officer evaluates whether the facts align with a violation of the honor code. Approval: If a preliminary violation is identified, the matter is presented to the Commandant of the Cadet Regiment, King's Guard, to request formal approval to convene the Honor Court. Right to Challenge: The accused may request to change committee members if there is a conflict of interest or a history of personal disputes. 2. Inquiry Stage The two investigators should maintain separate roles: while one conducts the direct examination, the other should conduct the cross-examination. Documentation: Both still photography and video recordings must be maintained throughout the entire inquiry process. Verdict: After hearing all evidence, the 25 jurors are responsible for determining whether the accused is guilty.3. Post-Inquiry Stage The accused maintains the right to appeal the decision Finality and Fairness: The results of the Honor Court are not considered final for the purposes of punishment. A separate fact-finding committee may be appointed to investigate the actions simultaneously to ensure fairness to the accused and to provide comprehensive data for superiors to consider in their final judgment.
