On the Rule of Law

Abstract

This article focuses on the rule of law. According to the traditional ideas of Western philosophers, the rule of law had its roots in ancient Greece. From the argument that good governance should be governed by what? Between philosopher-king, or with good law. Aristotle, the Greek sage philosopher, concluded that only good law should govern. And it was from Aristotle's conclusions that it developed into the concept of public law of the modern state thousands of years later. For rule of law and good governance, professor Albert Wayne Daisy, a British constitutional theorist, brought Aristotle's idea that the law should govern instead of the people. Dicey used the term rule of law as "the rule of law", the term rule of law was included in the 1949 Regulations of the Council of Europe and the 1950 European Human Rights Convention. With the translation of the rule of law as "The greatness of the law", which the principle of the greatness of the law according to Daisy's concept was based on the important principle that no one was above the law. All persons were equal and all were equal before ordinary law  and courts were usually the defenders of the rights of individuals in what was known as "private property" which was a fundamental principle of the British common law system, which was different from the protection of individual rights and liberties in the European code system, which was based on the principle that the constitution was the defender of the rights and liberties of the individual. Therefore, the rule of law and good governance should place the law supreme and all people equal before the law by living under the principle of protecting the rights and liberties of the people by the judgment of the court.
