LEGAL PROBLEMS REGARDING THE PROMOTION AND DEVELOPMENT OF TOUR GUIDES IN THAILAND

Abstract

          This article aims to study concepts, principles, and legal theories regarding legal measures regarding the promotion and development of tour guides in foreign countries and Thailand, including analyzing legal problems related to the promotion and development of tour guides in Thailand. To suggest appropriate solutions for Thailand in solving legal problems related to the promotion and development of tour guides in Thailand. The results of the study found that the laws related to the promotion and development of tour guides in Thailand were found to still have problems regarding the use of There are many regulations, such as legal problems regarding the determination of qualifications and prohibited characteristics in applying for a tour guide license. Legal issues regarding the authority and duties of tour guides and local tour guides and legal problems regarding the determination of penalties for tour guides without any administrative penalties. Therefore, the researcher deems that there should be an amendment to the Tourist Business and Tour Guide Act, B.E. 2008, in the part of determining qualifications and prohibited characteristics in submitting Apply for a tour guide license by specifying that the qualifications for being a tour guide must pass a knowledge and ability test. and training in the Tour Guide Occupation Certificate Program as determined by the committee. and amending to allow general tour guides to act as tour guides in areas that the committee has declared to be local areas or specific communities. Including adding additional penalties that are administrative penalties in order to promote and develop tour guides in Thailand to be efficient and develop Thailand's tourism industry sustainably.
