Rights and Practices When a Soldier Is Charged in A Criminal Case

Abstract

Under the Constitution of the Kingdom of Thailand, all persons are equal before the law and rights and liberties shall be equally protected under the law. Unfair discrimination against a person shall not be permitted. In a criminal case, a suspect or defendant shall be presumed innocent before the passing of a final judgment. Knowing the rights and procedures of being accused in criminal cases, including the provision of the law, shall guarantee rights of military personnel when being accused. The accused soldiers, similarly to all that people, shall be presumed innocent until the court passes a final decision and equally enjoy the protection of the rights and liberties without discrimination.
