Abstract

This research aims to purpose a new concept to improve the petty offences in Book 3, Criminal Code of Thailand, which has been used for a long time, and for complying with the penalties and social conditions for the era by compared with the criminal offense of the French Republic and the Federal Republic of Germany. The study found that the new concepts improving criminal enforcement setting forth in the Thai Criminal Code are 1) The elevation some serious section of petty offences into criminal offenses, 2) The reduction of some section of criminal offenses to an administrative offense, and 3) The abolition of certain section of criminal offenses that there are other more appropriate provisions. Updates on this concept can cancel for petty offences. No more petty offences in Book 3, consistent with the Constitution of the Kingdom of Thailand B.E. 2560, Section 77, paragraph 3 which stipulates that "the State should only impose criminal penalties for serious offenses",  and social context in modern times.
