Abstract

This research aims to study the principles, theories, and legal frameworks relevant to the establishment and administration of private educational institutions, analyze the limitations imposed by the Private Schools Act B.E. 2550 (2007), and propose legal reforms that strike a balance between protecting educational standards and promoting entrepreneurial freedom. The study employs qualitative methodology through document analysis and comparative legal research, focusing on countries with strong regulatory frameworks for private education, namely Finland, Singapore and Japan.

The findings reveal that Thailand’s current law remains rigid and control-oriented, emphasizing structural and procedural compliance over educational outcomes. Such a legal environment challenges private schools' development and competitiveness. In contrast, foreign legal systems tend to support institutional autonomy with robust and transparent quality assurance mechanisms. This research proposes a “Balanced Regulation Model” as a reform framework, advocating policy directions that provide greater regulatory flexibility while ensuring public accountability in educational standards.
