Legal Measures on Population’s Debt Restructuring : Case Study on Informal Debt

Abstract

This research aims to seek appropriate legal measures to be used as guidelines for the amendment to laws on the household sector’s debt-restructuring in the case of informal debts, irrespective of whether they are the problems related to creditors’ taking advantage against the informal debtors, informal creditors’ taking advantage from being in breach of the Interest Control Act, fiscal burden resulted from debt-restructuring, and a large number of deteriorated assets in ad hoc financial institutions participating in household sector’s debt-restructuring programs. According to this research, the problems and obstacles on household sector’s debtrestructuring in the case of informal debts and their guidelines used in the household sector’s debt-restructuring in the case of informal debts are known. There are two recommendations for solving the household sector’s debt-structuring problems in the case of informal debts, namely, to establish the government agencies to supervise and solve the problems on a permanent basis and to amend laws on household sector’s debt-restructuring in the case of informal debts, to further be appropriate and in accordance with economic and social conditions.
