Legal Issues on Legalization of Gambling in Thailand

Abstract
Our world is in the globalization era. Some countries accept gambling and gambling debt as a legitimate debt, which can be brought into court. In Thailand, gambling is prohibited by the Gambling Act B.C. 2478. However, on October 25th, 2011, the Government approved a draft Gambling Bill, which “will legalize gambling debts. As a result of this amendment, gambling debts shall be legally processed in court”. This article aims to illustrate legal issues on allowing legalization of gambling under Thai law by studying the Gambling Act of B.E. 2478 (current Act) and the draft Gambling Bill to compare legal principle and purpose on debts as well as evidence for
taking legal action in this regard. Thailand, as a member of ASEAN Economic Community-AEC, should amend the Gambling Act so that gambling is a legitimate debt that can be brought into court. In relation to the matter of debt, gambling should finally be controlled by the government for economic, social and moral benefits.
