Characteristics of Illegal Language in Thai

Abstract
The objective of this study was to determine the characteristics of Thai language used in communication that constitute illegal speech acts under Thai law. The results revealed that for successful communication, the language users must have a good understanding of Thai language and not use it in an illegal manner, that is, in a manner that devalues or damages the reputation of others. The elements of language use that constitute illegal speech acts include the sender’s conscious intention to convey his knowledge and ideas to the receiver through media, and the receiver’s interpretation and response to the sender. If both parties communicate in an unethical, offensive manner, it is against both civil and criminal laws. The units of language used in communication that constitute illegal speech acts include discourse, sentence and phrase, or utterance and word. These units may have either explicit or implicit meanings. The language user is deemed to have committed an offense under Civil and Commercial Code or Criminal Code if the language units they used are consistent with the elements of illegal speech acts.
