Problem on Provisions to Sue Bankruptcy Case after the Spreading of Covid-19

Abstract

The spreading of COVID 19 affects to economic at the present and in the future which directly affects the citizens. This importantly causes decreased domestic consumption and export. Moreover, this may lead to the economic crisis of many insolvents. Bankruptcy law, as an important measure to manage the debts, has the strict provisions and conditions to sue the case which is not inconsistent with the economic situation in the future. This academic article aims to study the economic measures of the state in the spreading situation of COVID-19, Bankruptcy Act, B.E. 2483 issuing of the provisions and conditions to sue the bankruptcy case, and suggesting the solution to manage the debts properly to the economy after the spreading of COVID-19 by reviewing the documents relating the economic measures of the state and Bankruptcy Act, B.E. 2483.

           According to the study, it is suggested to let the debtor requiring to be the bankrupt person by themselves and to add the measure of debt relief as same as the bankrupt law of the United Kingdom.
