An Approaches to the Development of the Real Estate Brokerage Law : A Comparative Study between Thailand and Malaysia.
Abstract
The objectives of this research were ; (1) to study and analyze problems and obstacles in the development of real estate brokerage laws, (2) to study, analyze and compare Thai laws and Malaysian laws related to real estate brokerage. The method of researching documents and comparing them with the laws of Malaysia to provide guidelines for the development of real estate brokerage laws in Thailand.
The results of study show that ; Thai laws related to existing real estate brokerage are not comprehensive and mandatory conditions for the profession. Therefore, anyone can engage in this profession and consumers face the risk of being deceived by brokerage. The license does not have qualifications or standards, including penalties for misconduct or fraudulent consumer behavior.
The recommendations of this study suggest enacting laws or measures to control real estate brokerage, and enacting them as act. The following standards have been established: (1) qualifications of license applicants, (2) control of the organization, and (3) penalties.
