Analysis of Environmental Context in Adjudicating Insult Offenses under Section 393 of Thai Penal Code: A Study of Supreme Court Judgments

Abstract

The current expansion of societal openness to freedom of expression has led to a significant increase in insult accusations under Section 393 of the Criminal Code. Recognizing contextual factors that impact whether conduct constitutes an insult offense is critical for legal professionals and civilians under the law. Nonetheless, extensive systematic study on how environmental factors affect the adjudication of insult offenses is absent. This qualitative study aims to analyze the relationship between contextual circumstances and legal components, and to propose a preliminary guideline for adjudicating insult offenses under Section 393 by considering important contextual factors. The study employs text analysis of 65 Supreme Court decisions addressing insult offenses under Section 393, which incorporate criminal law doctrines. According to research findings, courts make decisions based on more than just literal word definitions but also on important environmental factors. The study finds eight contextual elements that influence judicial decision-making: word meaning, language roughness, dissemination methods, distance between parties, reciprocal engagement, victim status, reputational damage, and speaker intention. Courts treat word meaning and speaker intention as decisive factors; victim status, dissemination methods, language roughness and reputational damage as supporting factors; while reciprocal engagement and distance between parties may operate as negating factors that render the conduct non-criminal in a number of cases. These research findings contribute to establishing preliminary recommendations for judging insult accusations under Section 393, provide practical applications for case adjudication, and raise public knowledge of conduct that may constitute insulting behavior.
