วิเคราะห์มาตรการทางกฎหมายเกี่ยวกับความลับทางการค้าของประเทศไทยเปรียบเทียบกฎหมายต่างประเทศ : ศึกษากรณีสินค้าขนมหม้อแกงเมืองเพชร

บทคัดย่อ
สูตรสินค้าขนมหม้อแกงเมืองเพชรและสูตรสินค้าอาหารไทย คือ ผลผลิตจากภูมิปัญญาท้องถิ่นของชาวไทยที่ยังคงเป็นความลับทางการค้าและเป็นข้อมูลสารสนเทศที่ไม่เปิดเผย (undisclosed information) ตามนัยยะข้อ 39.2 (b) ความตกลงทริปส์ สูตรอาหารจึงได้รับความคุ้มครองตามมาตรา 3 พระราชบัญญัติความลับทางการค้า พ.ศ.2545 ของประเทศไทยและมาตรการกฎหมายความลับทางการค้าของภาคีความตกลงทริปส์อื่น ๆ แต่เมื่อความตกลงทริปส์ตั้งอยู่บนหลักมาตรฐานขั้นต่ำภาคีต่าง ๆ จึงใช้มาตรการกฎหมายความลับทางการค้าที่มีรายละเอียดแตกต่างกัน ซึ่งสำหรับประเทศไทยแล้วกฎหมายเฉพาะ (sui generis) พระราชบัญญัติความลับทางการค้า พ.ศ.2545 ยังคงเป็นกฎหมายเหมาะสมเพื่อการปกป้องประโยชน์ในเชิงพาณิชย์และอนุรักษ์ภูมิปัญญาท้องถิ่นสูตรสินค้าอาหารไทยแต่ประเทศไทยก็ควรแก้ไขกฎหมายฉบับนี้ในบางประเด็น เช่น การเพิ่มเติมข้อมูลเทคโนโลยีไว้ในคำนิยามศัพท์ข้อมูลการค้าการเพิ่มบทบัญญัติรับรองสิทธิในความลับทางการค้าของลูกจ้างการจดแจ้งความลับทางการค้ากับกรมทรัพย์สินทางปัญญาและการนำการเยียวยาทางปกครองมาใช้โดยการแก้ไขทั้งหมดนี้ ประเทศไทยต้องปฏิบัติตามกรอบพันธกรณีความตกลงทริปส์และเรียนรู้ได้จากประสบการณ์ใช้มาตรการกฎหมายความลับทางการค้ากลุ่มประเทศที่เลือกศึกษา
