การศึกษาเปรียบเทียบกฎหมายไปรษณีย์ต่างประเทศเพื่อปรับปรุงกฎหมายไปรษณีย์ของประเทศไทย

บทคัดย่อ
บทความเรื่องนี้มีวัตถุประสงค์เพื่อศึกษา วิเคราะห์ และทบทวน พระราชบัญญัติไปรษณีย์ พุทธศักราช 2477 โดยเปรียบเทียบกับกฎหมายต่างประเทศ เช่น ประเทศสหรัฐอเมริกา สหพันธ์สาธารณรัฐเยอรมนี สหราชอาณาจักร สาธารณรัฐสิงคโปร์ และสาธารณรัฐอินโดนีเซีย เพื่อนำมาวิเคราะห์และจัดทำข้อเสนอแนะเพื่อปรับปรุงพระราชบัญญัติไปรษณีย์ให้มีความเป็นสากลเหมาะสมกับยุคปัจจุบันเพื่อให้บริการประชาชนอย่างมีประสิทธิภาพ โดยใช้เครื่องมือการวิจัยเอกสาร ผลการศึกษาพบว่า พระราชบัญญัติไปรษณีย์ พุทธศักราช 2477 ได้บังคับใช้มานานกว่า 90 ปี จึงทำให้บทบัญญัติส่วนใหญ่ ไม่เหมาะสมกับสภาพเศรษฐกิจและสังคม ตลอดจนวิถีชีวิตของประชาชนในยุคปัจจุบัน ควรปรับปรุงกฎหมายโดยเสนอให้มีการตั้งหน่วยงานกำกับดูแลที่มีความเป็นอิสระ ใช้ระบบใบอนุญาตร่วมกับระบบจดทะเบียน มีการสนับสนุนบริการไปรษณีย์พื้นฐานโดยทั่วถึง และปรับรูปแบบการลงโทษให้เป็นโทษทางปกครองมากกว่าโทษทางอาญา
