ความเสมอภาคตามกฎหมายกับช่องว่างในการปฏิบัติจริง: การประเมินการทำให้สิทธิแรงงานเกิดผลของแรงงานชาย หญิง และแรงงาน LGBTQ+ ในประเทศไทย ระหว่างปี 2015–2025

บทคัดย่อ
การศึกษานี้ตรวจสอบว่าการปฏิรูปกฎหมายที่เกี่ยวข้องกับความเสมอภาคของประเทศไทยได้แปรเปลี่ยนไปสู่การทำให้สิทธิแรงงานเกิดผลเป็นจริงอย่างมีนัยสำคัญสำหรับแรงงานชาย แรงงานหญิง และแรงงาน LGBTQ+ ในช่วงปี 2015–2025 หรือไม่ โดยใช้แบบแผนการวิจัยแบบผสมเชิงอธิบายตามลำดับการศึกษาผสานการวิเคราะห์ข้อมูลกำลังแรงงานระดับจังหวัด–อุตสาหกรรมหลักฐานการเปิดเผยข้อมูลระดับบริษัท และการสัมภาษณ์เชิงคุณภาพกับผู้ให้ข้อมูลสำคัญจำนวน 15 ราย โดยตีความผ่านดัชนีการทำให้สิทธิเกิดผลเป็นจริงห้ามิติ (Rights Realization Index: RRI) ผลการวิจัยชี้ให้เห็นถึงความก้าวหน้าเชิงบวกแต่ไม่สม่ำเสมอของความเสมอภาคในสถานที่ทำงานโดยการปรับปรุงมีความเด่นชัดกว่าในผลลัพธ์ที่ถูกขับเคลื่อนผ่านกระบวนการทางการบริหาร โดยเฉพาะการเข้าถึงสิทธิประโยชน์ภายหลังการปฏิรูปสมรสเท่าเทียม ซึ่งมีผลใช้บังคับเมื่อวันที่ 23 มกราคม 2025 มากกว่าผลลัพธ์เชิงลึกของตลาดแรงงาน เช่น ค่าจ้าง ตลอดช่วงเวลาศึกษา ค่า RRI เพิ่มขึ้นจาก 0.47 เป็น 0.63 สะท้อนการบรรจบกันในระดับปานกลางแต่ยังไม่สมบูรณ์ระหว่างการรับรองทางกฎหมายอย่างเป็นทางการกับความเสมอภาคที่เกิดขึ้นจริงในสถานที่ทำงาน หลักฐานเชิงบูรณาการระบุกลไกที่เกิดซ้ำ 4 ประการ ได้แก่ ความติดขัดทางการบริหารการปฏิบัติตามเชิงสัญลักษณ์ การออกแบบนโยบายที่ครอบคลุม และศักยภาพการบังคับใช้ที่ไม่สม่ำเสมอ กรณีของประเทศไทยแสดงให้เห็นว่าการปฏิรูปกฎหมายเป็นจุดตั้งต้นที่จำเป็น แต่ผลในทางปฏิบัติขึ้นอยู่กับความสามารถของสถาบัน ในการแปลงสิทธิที่เป็นทางการให้กลายเป็นการปฏิบัติที่เกิดขึ้นเป็นกิจวัตรในสถานที่ทำงาน
