“Two elephants in one room”: Analyzing the legal frameworks for disaster and water crisis management in Thailand, the Disaster Prevention and Mitigation Act B.E. 2550 (2007) and the Water Resources Act B.E. 2561 (2018)

Abstract
Thailand experiences an increasing water-related risks due to its socio-ecological context. The rising impacts from the global climate risks contributes to these ongoing concerns. The legal framework is recognized as an important mechanism for dealing with water-related disaster and crisis. Thailand utilizes the Disaster Prevention and Mitigation Act B.E. 2550 (2007) and Water Resources Act B.E. 2561 (2018) as the key mechanism for addressing the national and local water crisis and challenges. The aim of this research is to understand in-depth the significance and major differences of these two acts in relations to steps, practices and frameworks for water related disaster management in Thailand. This research adopts a qualitative approach to comparatively analyze these two acts by using conceptual framework on water related crisis and disaster management developed in this paper. Dealing with the water crisis requires coherent legal framework and comprehensively adoption and integration of these two legal frameworks for enabling the integrative risk management in practice. This research found that the asks for the systematic integration of both acts and in combination with other laws and regulation concerning proactive risk management and local participation in reducing water-related risks. The scope of this research is the analysis of the two most important water crisis and disaster-related laws in Thailand. Future research could investigate the other laws related to other specific socio-ecological policies and public sectors.
